Terms of Service

1. Acceptance of Terms
By creating a PrimeDNS account and using our DNS management services, you agree to these Terms of Service. If you do not agree, do not use our services. These Terms are provided by CONSERIT — Wojciech Sawaściuk (ul. Zygmuntowska 33/3, 31-314 Kraków, Poland, VAT ID PL 763-182-16-90, REGON 121014340), operator of the PrimeDNS platform at primedns.net.
2. Service Description
PrimeDNS provides professional DNS management services ("Services"), hosted within the European Union. The specific features and tools included depend on your plan and are described on our website and in your account panel; we may add, change, or retire individual features from time to time without amending these Terms, provided the core nature of the Services is not materially reduced for existing paid plans without notice under Section 12.
3. Account Registration
- You must provide accurate and current registration information
- You are responsible for maintaining the security of your account credentials
- One account per person or organisation; multiple accounts are not permitted
- You must be at least 18 years old or have parental consent
4. Acceptable Use
You may not use PrimeDNS to:
- Host DNS for domains used in spam, phishing, malware distribution, or illegal activities
- Intentionally degrade service performance for other users, or place excessive load on our DNS servers
- Attempt to gain unauthorised access to our systems
- Resell the service without prior written agreement
- Violate any applicable laws or regulations
We reserve the right to suspend or delete accounts that violate these terms, with or without prior notice depending on severity.
5. Plans and Payment
- A free plan is available with limited capacity; paid subscription plans with additional capacity and features are described on our Pricing/Billing pages
- Paid plans are billed periodically against a prepaid account balance ("wallet"), which you top up in advance
- All prices are in EUR and exclude VAT where applicable; EU VAT-registered businesses may provide their VAT number for reverse-charge invoicing
- Prepaid wallet funds are non-refundable, except as set out in Section 6 (Right of Withdrawal)
- Inactive free-plan accounts (no activity for more than 6 months) may be deleted
6. Right of Withdrawal
A Consumer or Entrepreneur with consumer rights may withdraw from the agreement within 14 days without giving any reason. This right does not apply after full performance of the service with the Consumer's express consent (e.g. activation of a paid DNS plan) or for digital content already delivered (prepaid top-ups already consumed by billing). This right likewise does not apply to services or digital content requiring an immediate, non-reversible payment to a third-party provider on the Customer's behalf — such as domain name registration or renewal, or SSL certificate issuance — once that payment has been submitted to the third party. In case of effective withdrawal, all eligible payments will be refunded within 14 days using the same payment method.
7. Service Availability
We aim for high availability across all plans and publish real-time service status. A formal Service Level Agreement with defined uptime targets and service credits is available for Business plan customers on request — contact us for current terms.
8. Data and Privacy
Our handling of personal data is governed by our Privacy Policy, which forms part of these Terms. We are GDPR compliant.
9. Intellectual Property
The PrimeDNS platform, software, and brand are owned by CONSERIT. Your DNS data (zone files, records) remains your property. We do not claim any rights to your data.
10. Limitation of Liability
To the maximum extent permitted by applicable law, CONSERIT's liability for indirect, incidental, or consequential damages arising from use of the Service is excluded. Our total liability for direct damages shall not exceed the fees paid by you in the 12 months prior to the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection law.
11. Complaints
Complaints may be submitted by email or in writing to the Operator's address (Section 1). We will process the complaint within 14 days of receipt; failure to respond within this period means the complaint is accepted. If you are a consumer resident in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr to resolve disputes out of court.
12. Changes to Terms
We may update these Terms. We will notify registered users by email at least 30 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of Poland (EU), without prejudice to any mandatory consumer-protection provisions of the law of your country of habitual residence that cannot be derogated from by agreement. For business customers, disputes shall be resolved exclusively in the courts having jurisdiction over the Operator's registered seat (Kraków, Poland). This clause does not deprive consumers of the right to bring proceedings in the courts of their country of residence under Regulation (EU) 1215/2012, nor of protections under the mandatory law of that country.
